Who Can File a Wrongful Death Claim in Tennessee?

In Tennessee, the following individuals may be entitled to file a wrongful death claim:

  • Surviving Spouse. This includes husbands and wives. It does not include ex-spouses or unmarried domestic partners.
  • Children of the Deceased. If there is no surviving spouse, or the surviving spouse forfeits their claim, children—including adopted children—have the right to file a claim.
