We are honored that lawyers refer us cases on a regular basis. Lawyers sometimes feel that their workload is too heavy such that they need to refer the case to our firm. For example, a lawyer that has a large caseload of domestic relations and/or criminal cases may simply feel that they do not have the time to devote to a case necessary to give it the attention it needs. Most often our referrals from other lawyers come because the focus of their practice is in other areas of law, and they seek our firm because we focus a large part of our practice in complex areas, such as medical malpractice, product liability, and catastrophic trucking and wrongful death cases. A medical malpractice case, for example, is an area of law in which many lawyers have little experience. Those cases can be very complex, and numerous legal technicalities are designed to derail a case, subjecting a lawyer to a potential legal malpractice claim. A variety of other hurdles also require experience to navigate. In some instances, the lawyer may actually be ethically required to refer the case to another firm if he or she does not have the required experience. We gladly review cases referred to us by other lawyers. Depending upon the case and the desires of the referring attorney and client, we can enter into a co-counsel relationship or accept the case on a simple referral, providing a mutually advantageous and ethical share of any fee garnered in the case.
A lawyer who wishes to simply refer us a case need only send us the case and enter into a retainer/fee agreement with the firm and the client. The lawyer then is ethically allowed to receive a referral fee without any additional participation.
